AppColl provides a mechanism for generating the US PTO's AIA/14 Application Data Sheet, by extracting information from your database and automatically populating the form, which can then be downloaded as a complete PDF file. The following article explains which portions of the form AppColl can populate and by which means.


 

Please Note: This article applies to the new ADS form valid until November 2020.


 

Inventorship

AppColl populates this section using the inventors listed in the Matter Details page, along with the details (address, citizenship, residence, etc.) of their individual records in the Contacts module.


 

Correspondence Information

If the client for the matter has a customer number in its contact record, AppColl uses this number in the customer number field, along with the email address of the attorney for the matter.


 

If the client's customer number field is blank, AppColl uses the customer number and email address of the attorney for the matter.


 

If the customer numbers for both the client and the attorney for the matter are blank, the "An Address is being provided for the correspondence Information of this application" box is checked and the contact record details for the attorney for the matter are used. 


 

Application Information 

AppColl populates this portion of the form exactly as listed in the Matter Details page. Small entity is selected if it is set in the matter. If not, AppColl checks the client contact record and selects small entity if the field is set there. If small entity doesn't exist in either location, AppColl uses large entity. Micro entity is ignored since the value is not available on the ADS form.


 

Filing by Reference 

AppColl does not populate this information.


 

Publication Information 

AppColl selects the correct check box for Request Early Publication or Request Not to Publish based on the value(s) selected for the matter.


 

Representative Information

AppColl uses the attorney for the matter's customer number, if available. If that field is blank, AppColl uses the client for the matter's customer number, if available. If there is no customer number for either, AppColl selects the "US Patent Practitioner" radio button and uses the attorney for the matter's name and patent registration number.


 

Domestic Benefit/National Stage Info

AppColl populates this information based on the "Related Matters" matrix for the matter. To ensure all required connects are included, AppColl uses every connection in the matrix.


 

Foreign Priority Info

Authorization or Opt-Out of Authorization to Permit Access

AppColl does not populate this section.


 

Statement under 37 CFR 1.55 or 1.78 for AIA (First Inventor to File) Transition Applications 

AppColl does not populate this section.


 

Applicant Information

This section is strictly populated with any applicants listed in the matter details page. Multiple applicants are supported.

  • The "assignee" radio button is selected for an applicant if the applicant's contact record has a role of assignee.
  • The "Legal Representative under 35 U.S.C. 117" radio button is selected for an applicant if the applicant's contact record has a role of Legal Representative.
  • The "Joint Inventor" radio button is checked for an applicant if the applicant's contact record has a role of inventor.
  • The "Person who shows sufficient proprietary interest" radio button is selected for an applicant if the applicant's contact record has a role of Party of Interest.
  • The "Person to whom the inventor is obligated to assign" radio is never checked.

Assignee Information

This section is strictly populated with any assignees listed in the matter details page. Multiple assignees are supported.

  • The "If the Assignee or Non-Applicant Assignee is an Organization check here" check box is checked if the assignee's contact record has a value in the Employed By or Company fields. The "Organization Name" field is populated with the company or employed by value.
  • The "If the Assignee or Non-Applicant Assignee is an Organization check here" check box is not checked if the assignee's contact record has a value in the first name or last name fields. When the check box is unchecked, the "Organization Name" field is replaced with  "Given Name" fields which are populated with the First, Middle, and Last name fields in the contact record.

Signature

AppColl populates this section with the name and patent registration number of the matter attorney. AppColl populates the date field with the date the PDF file is created, and leaves the signature field blank.
